These Terms of Use (“Terms”) govern your access to and use of the services provided by Foodweb Ghana Limited (“Foodweb,” “we,” “our,” “us”), including our website, mobile application, and any other platforms or services we operate (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.
1. Eligibility
You must be at least 18 years old or have parental/guardian consent to use our Services.
By creating an account, you represent that all information provided is accurate, complete, and kept up to date.
2. Account Registration and Security
To use certain features of our Services, you may be required to create an account.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately of any unauthorized access or security breach.
Foodweb will not be liable for any losses caused by unauthorized account use.
3. Orders and Payments
Orders can only be placed through our official platforms.
By placing an order, you make a binding offer to purchase selected products at the listed prices.
Foodweb reserves the right to accept or reject orders at our discretion.
All payments must be made in full before delivery unless otherwise communicated.
Accepted payment methods include Foodweb Wallet, mobile money, credit/debit card, and bank transfer.
4. Pricing and Availability
All prices listed are in Ghana Cedis (GHS) and include applicable taxes unless stated otherwise.
Product availability may vary. Foodweb reserves the right to change or discontinue products without prior notice.
In the event of pricing errors, Foodweb reserves the right to cancel or adjust orders.
5. Delivery and Fulfillment
Foodweb operates on a pre-order and scheduled delivery system. Customers place orders within a given week, and deliveries are fulfilled the following week.
Delivery times are estimates and may vary due to location, product availability, or unforeseen circumstances.
Risk of loss and title to products pass to the customer upon delivery.
Customers are responsible for providing accurate delivery details. Foodweb is not liable for failed deliveries due to incorrect information.
6. Cancellations, Returns, and Refunds
Orders may be canceled or modified within 24 hours of placement.
Due to the perishable nature of food items, returns are generally not accepted unless products are defective or damaged upon delivery.
Refunds, where applicable, will be processed to the original payment method or Foodweb Wallet within a reasonable time.
Customers must report issues (damaged, missing, or spoiled items) within 24 hours of delivery for resolution.
7. Product Quality and Standards
Foodweb guarantees that all products are sourced fresh and handled with care.
We do not make any warranties, express or implied, regarding suitability for a particular purpose beyond what is required by Ghanaian law.
Pictures of products on the website or app are for illustration purposes only; actual products may vary slightly.
8. Acceptable Use
You agree not to use our Services to:
Engage in fraudulent, illegal, or unauthorized activities.
Interfere with or disrupt our systems or networks.
Circumvent any security measures.
Resell or redistribute products purchased from Foodweb without written authorization.
9. Intellectual Property
All content on Foodweb’s platforms—including logos, trademarks, images, text, product descriptions, and software—is the property of Foodweb Ghana Limited and protected by copyright and intellectual property laws.
You may not reproduce, modify, distribute, or exploit any content without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Foodweb shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of our Services.
Our total liability in connection with any claim shall not exceed the amount paid by you for the specific order in dispute.
11. Indemnification
You agree to indemnify and hold harmless Foodweb, its employees, directors, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of our Services or violation of these Terms.
12. Privacy and Data Protection
Your use of our Services is also governed by our Privacy Policy.
By using Foodweb, you consent to the collection, storage, and processing of your personal information in accordance with Ghana’s Data Protection Act, 2012 (Act 843).
13. Termination
Foodweb reserves the right to suspend or terminate your account at any time for violation of these Terms or misuse of Services.
You may close your account at any time by contacting customer support.
14. Changes to the Terms
Foodweb may update these Terms from time to time.
Updated Terms will be posted on our website and app with a revised effective date.
Continued use of our Services after changes indicates acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Ghana.
Any disputes arising out of these Terms shall first be resolved amicably. If unresolved, disputes shall be referred to arbitration in accordance with Ghanaian law.
